Terms of Service

Effective October 12, 2026

These terms are a contract between you and NewMent Inc. ("NewMent", "we", "us"), the company that operates Voiceful at getvoiceful.com. They cover the Voiceful web app, the softphone, the desktop and browser extension apps, the API, and everything else we provide under the Voiceful name (together, the "Service"). By creating an account or using the Service you agree to them. If you are signing up for a company, you confirm you can bind that company, and "you" means the company.

1. Who can use Voiceful

Voiceful is a business tool. You must be at least 18 and using it for a business, nonprofit or professional purpose. It is not offered for personal or household use. You are responsible for every user you invite to your organization and for keeping login credentials private.

2. What the Service does

Voiceful lets you buy or connect phone numbers, place and receive calls, send and receive text messages, take voicemail, record and transcribe calls, get AI summaries and coaching notes, and run AI voice agents that make or answer calls for you. Features change over time. Some are in beta and may be rough or withdrawn.

3. You are responsible for lawful calling and texting

Voiceful is the tool. You decide who to call and text, what to say, and whether to record. Telephone and messaging laws apply to you as the caller or sender, and you agree to follow them. That includes at least the following.

  • Call recording consent. California and a number of other states require every party to a call to consent before it is recorded. If you record calls, you are responsible for getting consent wherever the law requires it, for every party, on inbound and outbound calls. Voiceful does not play a recording notice for you; put one in your greeting and tell the people you call.
  • TCPA and prior express consent. Under the Telephone Consumer Protection Act and similar state laws, calls made with an autodialer, an artificial or prerecorded voice, or an AI voice agent, and marketing texts, generally need the recipient's prior express consent, and prior express written consent for telemarketing. You must have that consent before you use the Service to place those calls or send those messages, and you must be able to prove it.
  • Opt-outs. You must honor opt-out requests promptly, by any reasonable method the person uses. When someone texts STOP (or a similar keyword) to one of your numbers, Voiceful marks the contact as opted out and blocks further texts from your organization to that number. You must also honor opt-outs that reach you some other way, and keep and check any do-not-call lists that apply to you.
  • A2P 10DLC registration. Business texting to US numbers over standard long codes requires brand and campaign registration with the carriers. You must give us accurate registration information and only send the kind of messages your registered campaign describes. Unregistered or mismatched traffic can be filtered or blocked by carriers, and we are not responsible for that.
  • No robocall spam. You may not use the Service for unsolicited bulk calls or texts, number spoofing, caller ID you are not entitled to use, or calling hours that violate the law.
  • Emergency calls. Voiceful is not a replacement for a landline or mobile phone for emergencies. Do not use the Service to call 911 or other emergency numbers except where we expressly support it, and keep another way to reach emergency services.

4. AI voice agents

If you deploy an AI voice agent, it must say that it is an AI (or an automated assistant) at the start of the call, and it must not claim to be a human if asked. You write or approve the agent's instructions and scripts and you are responsible for what it says, including any offers, promises or disclosures. Everything in section 3 applies to agent calls, and AI-voice calls count as artificial-voice calls under the TCPA.

5. AI transcripts, summaries and coaching

Transcripts, summaries, scores, coaching tips and other AI output are produced automatically and are often wrong in small ways and sometimes in large ones. Names, numbers and accents trip them up. Check anything that matters against the recording before you rely on it, and do not use AI output as the only basis for a decision about a person's employment, credit, housing or legal rights.

6. Usage limits and toll fraud

Outbound calling and texting are limited to US and Canadian destinations. We block some North American area codes known for high-cost or fraudulent traffic, and we may set or change rate limits, spending caps and other usage limits at any time to protect you, us and the phone network. You are responsible for charges from activity on your account, including activity by someone who got in with your users' credentials, so protect them. Tell us right away at [email protected] if you see calls or texts you did not make. We may suspend numbers or accounts that show signs of fraud or abuse without notice.

7. Acceptable use

You agree not to use the Service to:

  • break any law, or help someone else do it;
  • harass, threaten, defraud or impersonate anyone;
  • send or play content that is illegal, sexually explicit involving minors, or that infringes someone's rights;
  • collect sensitive data such as full card numbers or health records over calls or texts without the safeguards the law requires;
  • probe, scan or test the Service's security, or get around limits, blocks or opt-out handling;
  • reverse engineer the Service, resell it without our written permission, or overload it.

8. Your content

You own your content: contacts, call recordings, voicemails, transcripts, messages, greetings, agent scripts and anything else you or your callers put into the Service. You give NewMent a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display that content only as needed to run, secure and support the Service for you, including sending it to the subprocessors listed in our Privacy Policy. NewMent does not use your content to train AI models of its own. You confirm you have the rights and consents needed for us to process it.

9. Copyright and repeat infringers

We respond to copyright notices under the Digital Millennium Copyright Act. See our DMCA policy for how to send a notice or a counter-notice. We will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

10. Fees

Paid plans, phone numbers and usage (minutes, messages, AI and transcription) are billed at the rates shown when you sign up or in your account. Carrier and regulatory fees may be passed through. Fees are non-refundable except where the law says otherwise. During a free beta we may start charging after giving you notice.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, NEWMENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. Calls and texts travel over carrier networks we do not control. We do not promise that every call will connect, every message will be delivered, every recording will be captured, or that the Service will be uninterrupted or error-free.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, NEWMENT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WARNED THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100.

13. Indemnity

You will defend and indemnify NewMent and its officers, employees and contractors against claims, fines, penalties and costs (including reasonable attorneys' fees) arising from your content, your calls and messages, your AI agents, your breach of these terms, or your violation of any law, including the TCPA, call-recording laws and carrier rules.

14. Suspension and termination

You can close your account at any time by contacting us. We may suspend or end your access if you break these terms, if your use creates legal or carrier risk, if you do not pay, or if we stop offering the Service. Where it is practical and lawful we will give notice first. After termination, your right to use the Service ends; sections 3, 4, 8, 11, 12, 13 and 16 survive. Phone numbers may be released back to the carrier.

15. Changes to these terms

We may update these terms. If a change is material we will tell you by email or in the app before it takes effect. If you keep using the Service after the effective date, the new terms apply. If you do not agree, stop using the Service and close your account.

16. Governing law and venue

California law governs these terms, without regard to its conflict-of-law rules. Any dispute will be heard only in the state or federal courts located in Los Angeles County, California, and both of us consent to their jurisdiction.
