NewMent Inc. operates Voiceful and respects copyright. If you believe material stored or shared through Voiceful, such as an uploaded greeting, hold music, a voicemail audio file or a message attachment, infringes your copyright, send us a notice as described below. We handle notices under the Digital Millennium Copyright Act, 17 U.S.C. 512.

Filing a notice

Under 17 U.S.C. 512(c)(3), your notice must be in writing and include:

  • a physical or electronic signature of the copyright owner or a person authorized to act for them;
  • identification of the copyrighted work you say is infringed (or, if there are several, a representative list);
  • identification of the material you say is infringing and enough information for us to find it, such as the phone number it plays on, the account name, or a link;
  • your name, mailing address, phone number and email;
  • a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

A notice missing these elements may not be valid. If you knowingly misrepresent that material is infringing, you can be liable for damages under 17 U.S.C. 512(f). When we get a valid notice we will remove or disable the material promptly and tell the user who posted it.

Filing a counter-notice

If your material was removed and you believe it was a mistake or misidentification, you can send our agent a counter-notice. Under 17 U.S.C. 512(g)(3), it must include:

  • your physical or electronic signature;
  • identification of the material that was removed and where it appeared before removal;
  • a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  • your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if you are outside the United States, any judicial district in which NewMent may be found), and that you will accept service of process from the person who sent the original notice or their agent.

After we receive a valid counter-notice, we send a copy to the person who filed the original notice. If they do not tell us within 10 business days that they have filed a court action to stop the activity, we will restore the material between 10 and 14 business days after receiving the counter-notice.

Repeat infringers

We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers. We count valid notices against an account, minus any that were successfully countered, and we may also act on clear infringement we find ourselves. See section 9 of our Terms of Service.
